Update: Proposal for a Regulation for a better enforcement of the GDPR
After an amended draft report was adopted on 15 February 2024 by the LIBE Committee in the European Parliament, we present an updated perspective on the proposed Regulation for additional procedural rules for GDPR enforcement. Following the European Commission's proposal and subsequent developments within the EU Parliament, our assessment reflects a nuanced perspective. While we welcome efforts to enhance cooperation between data protection authorities and harmonize procedural aspects across borders, we also address significant concerns regarding procedural safeguards and the potential for imbalance in complainants' rights in the EP proposal. Our position emphasizes the importance of striking a balance between efficient enforcement and safeguarding fundamental rights, underscoring the need for a thoughtful approach in shaping the regulatory landscape.
Our first position paper was published in August 2023 and refers only to the European Commission's proposal. You can find it here.
